Zahlreiche Stornierungen sowohl seitens der Reisenden als auch der Reiseanbieter:innen stellen die Recht…sanwender:innen vor neue Probleme, denen sich die Neuauflage des Tonner/Bergmann/Blankenburg widmet. Dazu gehört in erster Linie die Frage, wann ein Reisender von einer Reise zurücktreten kann, ohne Stornogebühren bezahlen zu müssen. Es gibt immer mehr Urteile dazu, doch eine klare Linie zeichnet sich keineswegs ab. Die Neuauflage arbeitet nicht nur die Judikatur auf, sondern weist auch Wege zur Lösung von Problemen, zu denen sich die Rechtsprechung bislang nicht äußern konnte.Ab dem 1. November 2021 ist im Reiserecht ein neues Insolvenzschutzrecht anzuwenden, das einen tiefen Einschnitt für das Reiserecht bedeutet und alle, die sich mit Reiserecht zu befassen haben, zum Umdenken zwingt. Der Gesetzgeber schreibt nunmehr einen Reisesicherungsfonds vor und erließ zu diesem Zweck ein eigenes Gesetz, das Reisesicherungsfondsgesetz (RSG). Eine ausführliche Darstellung der neuen Regelungen ist ein weiterer wesentlicher Gegenstand der Neuauflage. Schließlich reißt der Strom der Entscheidungen des EuGH zur FluggastrechteVO nicht ab, was Anlass zu einer gründlichen Überarbeitung des einschlägigen Abschnitts in der Neuauflage gab.
