Akut geworden ist die Abgrenzung zwischen vererblichem Vermà gen und unvererblichen Rechtspositionen in jüngerer Zeit unter anderem im Hinblick darauf, ob die vermà genswerten Bestandteile des Persà nlichkeitsrechts oder der sogenannte "digitale Nachlass" (Accounts etc.) dem Grundsatz der Gesamtrechtsnachfolge unterliegen. Die Untersuchung greift diese Aspekte auf und befasst sich mit den Rechtswirkungen der Hà chstpersà nlichkeit und etwaigen Spannungslagen zwischen dem Erbrecht und dem postmortalen Persà nlichkeitsschutz. So wird unter anderem im Lichte der Marlene Dietrich-Entscheidung der Frage nachgegangen, ob die Annahme eines Rechts an der Persà nlichkeit des Erblassers überzeugen kann. AuÃerdem geht die Untersuchung den sogenannten "unkà rperlichen" Gütern nach. Dieses Themenfeld wird immer dann relevant, wenn es zur Verkà rperung bzw. Vergegenständlichung von Persà nlichkeitsmerkmalen des Erblassers gekommen ist. Da sowohl im digitalen als auch im analogen Bereich Verkà rperungen bzw. vertragliche Fixierungen vorstellbar sind, kann der Inhalt eines betreffenden Rechts oder Schuldverhältnisses durch die Persà nlichkeit des Erblassers unterschiedlichen Veränderungen unterliegen. Exemplarisch sei auf das Eigentum am Tagebuch oder auf den Nutzungsvertrag bei Social Media-Accounts verwiesen. Zu bedenken ist jedoch, dass es aufgrund der Vielfalt von denkbaren Einzelfällen im Grunde logisch unmà glich ist, Antworten mit axiomatischer Gültigkeit zu liefern. Ziel der Arbeit ist es vielmehr, Grundlagen zur näheren Bestimmung der güterzuordnungsrelevanten Wirkungsfähigkeit des § 1922 Abs. 1 BGB zu legen, um darauf aufbauend eine stärkere Abgrenzung zwischen vererblichem Vermà gen und unvererblichen Rechtspositionen zu ermà glichen.
