It is quite evident that such international or global legal framework cannot be designed on the basis of a traditional sovereignity-oriented international law. One can observe that international law has begun to react to the new environment in which it is to function more effectively. Modifications of the modes of creating adequate legal norms and efforts to broaden the scope of relevant international legal norms as well as to strengthen their enforceability vis-à-vis third states as in the case of the now well recognized norms with erga omnes effect are sure indications of the changing nature of international law in an era of global hazards. The 1996 International Law Symposium 'The New Trends in International Lawmaking - International 'Legislation' in the Public Interest' brought together 28 leading scholars from the United States and Europe with a view to probe into these recent developments in the international legal order.; New threat scenarios include global environmental hazards, poverty generated mass migrations, and international terrorism which in view of the still not satisfactorily solved problem of containing the proliferation of weapons of mass destruction has taken on a new dimension. The aim of these thematically closely related symposia, bringing together eminent international legal scholars, was to explore the structural changes that the international system and its legal order were undergoing due to the forces of globalization and the political upheavals following the end of the ideological division of the world. The present papers and proceedings of the fifth conference of the series of symposia brings this project to an end. The authors are exploring the meaning of the concept of the international law of cooperation and the obligation to cooperate in three important areas of modern international law: the international protection of human rights (Lori Fisler Damrosch, New York) international economic and environmental law (Christian Tietje, Halle) and international dispute settlement (Anne Peters, Basel). The implications of the state obligations to cooperate for the conceptualization of sovereingty in present international law are the subject of the fourth paper (Christoph Schreuer, Wien). Although the host of information, provided by the rapporteurs, revealed the immense importance of obligations to cooperate in international conventional law as a steering tool in international relations it also became clear that a general concretization of the meaning of obligations to cooperate cannot presently be established - if ever. The concrete meaning of the obligation to cooperate has to be interpreted within the actual context in which such obligations are stipulated. Heinegg (Frankfurt/O.) who raises the question whether the traditional methods in developing new rules of customary international law are still valid with regard to international criminal law, taking into account in particular the fast developing jurisprudence of the two ad hoc Tribunals created by the Security Council and potential conflicts with the role of State practice as traditionally understood. Jan Klabbers (University of Helsinki) focuses on the role of third States, in particular the role of third States not parties to the Statute of the International Criminal Court, where he highlights the conflict between the traditional pacta tertiis rule and more modern approaches and understandings of international law. In a similar vein, Christine Chinkin (London School of Economics) demonstrates to what extent feminist approaches to international law have shaped our understanding of international criminal law and raises the question whether this development is part of an overall and more generalized movement. Finally, Leila Sadat (Washington University School of Law, St. Louis, Missouri) addresses the difficult question of the relationship betwe; International Criminal Law is one of the most vibrant and fast developing areas of international law. It is against this background that the Walther Schücking Institute at Kiel University organized a symposium aiming at analyzing whether and if so, to what extent international criminal law is exercizing influence on general public international law or whether international criminal law has instead become a separate field of law of its own with its specific methods and which therefore no longer is part of general international law.This volume contains all presentations given during the conference as well as the discussions that took place. Speakers include Hans-Peter Kaul, currently judge at the International Criminal Court, who outlines the current challenges for the newly established Court as well as Wolff Heintschel v.
