Sebastian VANTIUS, ein vermutlich in der Rechtspraxis tätiger Jurist aus Rimini, lebte im 16. Jahrhundert. Sein prozessuales Werk über die Nichtigkeit von Prozeß und Urteil war ein weit verbreitetes, vornehmlich an deutschen Gerichte…n oft benutztes Werk. Aus dem römischen Recht waren bereits eine Reihe von Nichtigkeitsgründen bekannt. Ähnlich wie heute zählten dazu in vielen Fällen der Mangel an Prozeßvoraussetzungen, daneben auch Verfahrensmängel. Im römischen Recht konnte die Nichtigkeit eines Urteils ohne ein weiteres Verfahren geltend gemacht werden, aber auch in der Appellation vorgetragen werden. Insbesondere konnte es der Vollstreckung entgegenwirken.
