Second edition, first by the Aldine press, of this bestseller legal treatise on procedural nullity, that is the annulment of a legal act or a procedure. First published in 1552 in Lyon, this is Vanzi's only work: with twenty-four editions printed before 1625, the 'Tractatus' earned the author international fame. Sebastiano Vanzi of Rimini (d. 1571) was an Italian jurist and lawyer who held the post of lieutenant of the auditor general of the Camera Apostolica in Rome under Pope Paul IV. In 1554, he was appointed bishop of Orvieto and attended the last session of the Council of Trent as one of the diffinitors. 'Tractatus de nullitatibus', defined as "useful and extensive" by the author, is a brief but comprehensive discussion on the legal concepts of nullity and annullment. In Roman civil and criminal law, a sentence, judgement or legal act can be declared null in the absence of an element which is deemed essential to the effectiveness of the procedure e.g. if the law was not fully followed, or infringed. In this treatise, Vanzi provides a general definition of the concept of nullity together with its etymology. The author explains how null procedures or sentences can be recognised (i.e. they are 'missing' something), indicates who has the right to raise a claim of nullity during a trial or outside the court (i.e. all the actors involved) showcasing different situations. Vanzi also specifies in front of whom a plea of nullity has to be raised and who has the power to evaluate and annul (e.g. an appointed judge). The author describes in detail different types of nullity - e.g. "ex defectu iurisditionis", "ex defectu citationis", "ex defecto processus" and how they can be 'repaired'. The manuscript ex libris on the title page belongs to 'Ulpianus Constantinus Firmanus', most likely Ulpiano Costantini of Fermo, a city in the Marche region (central Italy). Ulpiano (mid. XVII century) was a member of the ancient and noble Costantini family and a professor of jurisprudence at the University of Fermo (see 'Enciclopedia storico-nobiliare italiana', Vol. II, 1981, p. 564). Margine superiore esterno bianco del frontespizio parzialmente innestato in antico per circa 1,5/2 cm., senza alcuna lacuna di testo, una lieve arrossatura su poche pp. dovuta al tipo di carta, peraltro esemplare in stato di conservazione molto buono. Rara edizione di questa celebre opera giuridica sulla nullità procedurale, ovvero l' annullamento di un atto giuridico o di una procedura; l' unica opera scritta da Sebastiano Vanzi, giurista riminese forse già allievo a Bologna di Andrea Alciato, e luogotenente dell' Auditore Generale della Camera Apostolica a Roma sotto papa Paolo IV che lo nominò Auditore della Sacra Rota e suo Consultore. Nel 1562 fu nominato vescovo di Orvieto e partecipò all' ultima sessione del Concilio di Trento come uno dei dissenzienti. Il volume rappresenta uno dei più importanti trattati di diritto processuale del Rinascimento, distinguendosi per un ordine espositivo molto chiaro ed elegante, arricchito da un corposo indice alfabetico, index rerum et verborum, volto a facilitare la consultazione rapida durante i processi. L' autore fornisce nel testo i concetti legali di nullità e annullamento degli atti giudiziari e delle sentenze, sia nel diritto civile che in quello penale e canonico, ed analizza in modo dettagliato e sistematico i vizi procedurali in grado di invalidare un processo o di rendere nulla una sentenza definitiva. Un atto veniva dichiarato nullo qualora mancassero elementi essenziali alla sua validità o fossero state violate le norme procedurali. L' autore spiega come si possano riconoscere atti o sentenze nulli, ovvero, privi di un elemento essenziale, delineando inoltre quali autorità avevano il diritto di rivendicare la nullità all' interno o all' esterno dell' aula di tribunale e come una sentenza impugnata poteva essere difesa, riabilitata o annullata definitivamente da un giudice, illustrando diverse situazioni. Vanzi specifica inoltre di fronte a chi deve essere sollevata l' eccezione di nullità e chi ha il potere di valutare e annullare, ad esempio, un giudice designato. L' autore descrive anche nel dettaglio le diverse tipologie di nullità, come la mancanza di giurisdizione, ex defectu iurisditionis, citazioni errate o mancanti, ex defectu citationis, vizi procedurali, ex defecto processus, e come queste possano essere sanate. Come recita il frontespizio, il testo era considerato "necessario" e pensato per essere uno strumento pratico e indispensabile per i giudici, iudicibus), gli avvocati, causarum patronis, e i funzionari che operavano in particolare nel foro romano. Sebastiano Vanzi sarà definito dagli storici del diritto come un' autorità indiscussa della procedura romano-canonica, ed il suo trattato ebbe una vastissima diffusione in tutta Europa, venendo costantemente ristampato a Venezia, Lione e Colonia fino all' inizio del XVIII secolo quando, la sua ultima edizione fu pubblicata nel 1717. First published in Venice in 1554, this work served as a standard treatise on the errors and omissions that could nullify trials, legal actions, and verdicts. Its final edition was published in 1717. The text provides structured guidance for lawyers and judges practicing in Roman and ecclesiastical courts. It emphasizes specific failures that void a trial, such as lack of jurisdiction (ex defectu iurisdictionis), faulty or missing summonses (ex defectu citationis), and procedural defects (ex defectu processus). It also outlines which authorities held the right to claim nullity inside or outside the courtroom, and how a contested sentence could be defended, rehabilitated, or definitively annulled by a judge. The author, whose name is sometimes recorded as Vanti or Vantio, was a highly regarded legal expert from Rimini who later served as a bishop. This copy was owned by two of Virginia Woolf's brothers-in-law (both younger brothers of Leonard Woolf). Cecil Woolf [1887-1917] was a promising poet and translator who was killed in action during World War I. He was serving alongside his brother, Philip Sidney Woolf [1889-1962], who was severely wounded by the shell that killed Cecil. A collection of Cecil's poems, featuring a preface by Philip, was printed for private circulation by Leonard and Virginia Woolf's famous Hogarth Press in 1918. All editions of this work are scarce.
