In der Studie sollen deshalb die Auswirkungen von Cross-border-Leasingverträgen auf die kommunale Selbstverwaltung thematisie…rt werden. Hierfür müssen die Vorteile und die Risiken dieser Finanzierungsquelle analysiert werden. Betrachtet wird zum einen der formelle Aufbau einer Transaktion, in welchem das Vertragswerk, die transaktionsbedingten Zahlungsströme und die beteiligten Akteure vorgestellt werden. Zum anderen erörtert die Arbeit die Vorgaben und Anforderungen für den Abschluss derartiger Transaktionen aus kommunaler Sicht, unter Einbeziehung landes- und bundespolitischer Überlegungen. Aufgrund des internationalen Charakters dieses Rechtsgeschäftes wird in einem weiteren Schritt die amerikanische Vertragsseite mit einbezogen. Abschließend soll der Frage nachgegangen werden, inwieweit Cross-border-Leasing auch zukünftig als Finanzierungsinstrument zur Sanierung öffentlicher Haushalte genutzt werden kann.
