In diesem Fall b…estehen zwei Konkretisierungen im Tatplan, einmal hinsichtlich des Zielobjekts und einmal bezüglich des Angriffsobjekts der Kausalkette. Die tatsächliche Geschehensentwicklung ist jedoch anders als geplant, weshalb von einem Doppelindividualisierungsirrtum die Rede ist. Ein Beispiel: Der Täter baut in das Auto des B eine Bombe ein, um ihn beim Start zu töten. Ausnahmsweise benutzt jedoch dessen Frau das Auto und stirbt durch die Explosion.In seiner Untersuchung hat Yu-An Hsu festgestellt, dass die unterschiedlichen bisherigen Lösungsansätze aus der Perspektive von Psychologismus und Intellektualismus nicht in der Lage waren, die Problematik widerspruchsfrei zu bewältigen, denn der Täter kann seine Kenntnisse manipulieren. Aufgrund dieser Wechselbeziehung zwischen Wissen und Wollen kritisiert der Autor die bisherigen Meinungen. Sein Gegenmodell gründet er auf die Unterscheidung von Individuum und Person, sowie auf den Normbefolgungswillen und seinen Gegensatz, den Tatwillen, als Teile des normativen Willensbegriffs. Die subjektive Zurechnung bezieht sich auf die Bewertung der angewendeten subjektiven Befähigung des Handelnden, und ermöglicht es, den Tatwillen anhand der Art der pflichtwidrigen Reaktion des Handelnden festzustellen. Der Gemütszustand ist so zwar Gegenstand der Bewertung, nicht jedoch Bewertungsmaßstab. Durch die Unterscheidung von konkreter und abstrakter Kenntnis bleibt die Bewertung unabhängig davon, dass der Täter bei der Tatbegehung überhaupt nicht an deren Folgen denkt. Da die abstrakte Kenntnis die generellen Eigenschaften einer Tatsache oder einer Handlung enthält, ist diese Kenntnis jeder vernünftigen Person immanent. Der Tatwille als Vorsatz liegt dann vor, wenn ein beabsichtigtes Verhalten nach abstrakter Kenntnis mindestens regelmäßig eine Folge herbeiführt, gleichgültig, ob der Handelnde sich diese gewünscht oder vorgestellt hat.Mit der in dieser Arbeit vertretenen These werden die umstrittenen Irrtumsprobleme und die axiologisch ungerechte Behandlung der Tatsachenblindheit gelöst.; Dissertationsschrift.
