En 1964, Lémery publie D'une république à l'autre. Cet ouvrage constitue alors une offense envers le chef de l'état, Charles de Gaulle, et Lémery se retrouve e…n correctionnelle en 1965, à 90 ans. L'interrogatoire a lieu le 16 juin 1965 et il y explique notamment qu'il ne cherchait pas à attaquer le président de la république mais à rendre ses souvenirs de 1894 à 1944. Le passage sur de Gaulle n'est qu'un passage parmi d'autres, traitant d'un « militaire en rébellion contre son gouvernement », parlant notamment de la condamnation à mort par un tribunal régulier ou de l'attaque de Dakar à laquelle de Gaulle avait pris part. Le jugement sera rendu le 30 juin 1965. Gwénaël Bolloré (l'éditeur) et Lémery sont donc condamnés pour outrage. Ils doivent payer chacun 1000 francs d'amende et les passages incriminés dans le livres doivent être détruits. Les exemplaires mis en vente qui n'auraient pas été censurés pourront être saisis. Nos documents sont donc : Une première version tapuscrite de l'interrogatoire, 25p in-4, les premières agrafées dans une couverture papier, les autres volantes (avec marges déchirées sans manque de texte). Cette version contient de très nombreuses corrections autographes de Lémery. Notons que la pagination ne suit pas mais le texte est bien complet. Une lettre autographe signée à son ami Louis Guitard (1918-2009) daté du 15 juillet 1965 à propos des corrections à apporter. Il précise aussi en marge : « vous avez le jugement ». Une seconde version tapuscrite de l'interrogatoire suivi du jugement, 35p in-4, agrafées sous couverture papier. Cette version contient aussi des corrections autographes de Lémery, moins nombreuses que sur le premier document mais parfois assez longues aussi. Très bel ensemble.
