Diese schiefe Sicht der Dinge zu korrigieren, haben sich die CSC zum Ziel gesetzt. Zum einen bildete jeder der beiden Rechtskreise für sich schon keine monolithische Einheit, man braucht sich nur die Unterschiede vor Augen zu halten, die etwa das französische gegenüber dem deutschen Recht charakterisieren. Oder man nehme das US-amerikanische Recht, das sich immer deutlicher von der englischen Prägung des Common Law entfernt. Zum anderen hat sich das Modell der beiden voneinander isolierten Rechtskreise als brüchig und überlebt erwiesen; das Gemeinsame zwischen ihnen und die gegenseitige Beeinflussung stellen hier wie dort nicht zu übersehende gestaltende Kräfte der Rechtsentwicklung dar.
