Venezianische Ausgabe der Opera omnia des bedeutendsten europäischen Juristen! - Bartolus de Saxoferrato (1313-1357), einer der berühmtesten Juristen Europas überhaupt, war der bedeutendste Vertreter der Kommentatoren. Nach der juristisch-philologischen Erschließung des Corpus iuris civilis durch die Glossatoren wandten sich die Kommentatoren der Rechtspraxis zu. Bartolus suchte die gesamte Rechtsquellen- und Rechtsliteratur zusammenzufassen und auf die Bedürfnisse der Rechtspraxis auszurichten. Die Einheit der Rechtslehre, die Harmonie in der Überwindung widerstreitender Textstellen, also die scholastische Denk- und Interpretationsweise, standen nach wie vor im Vordergrund. In gewaltigen, eindrucksvollen Werken unterbreiten die Kommentatoren die gesamte Zivilrechtslehre dieser Zeit. Schon zu seinen Lebzeiten erlangte Bartolus außergewöhnlichen Ruhm: summus iuris commentator. Die Autorität von Bartolus war lange Zeit der der Glosse fast ebenbürtig: nemo bona iurista nisi bartolista. - Seine Opera omnia wurden mehrfach aufgelegt, fast ausschließlich in Italien, bis auf die berühmte Baseler Gesamtausgabe, die der humanistisch gesinnte Jurist Jacobus Concennatius während seines mehrjährigen Aufenthaltes in Basel bearbeitete und edierte. Zu dieser Zeit konkurrierten vor allem Turiner und Venezianer Drucke, die die Ausgaben des Bartolus mit eine Reihe von Anmerkungen bedeutender Juristen des 16. Jahrhunderts angereichert haben. Unter den Ausgaben zählt die vorliegende Venezianische zur umfangreichsten. Es ist eine gut bearbeitete und auch sehr gut leserliche Bartolus-Ausgabe, eine der bedeutendsten Ausgaben im 16. Précieux recueil d'opuscules juridiques, imprimés en caractères gothiques à Cologne dans les premières années du 16e siècle et réunis sous un même titre à la faveur du projet éditorial désigné par Stintzing sous le nom de "Kölner Sammelwerke" ("le recueil de Cologne"). Ce projet, peut-être unique en son genre, avait mobilisé plusieurs imprimeurs et libraires de la ville pour produire et assembler différents opuscules de droit très prisés des étudiants et des juristes. Publiés aussi bien séparément que sous la forme de recueils plus ou moins complets, ces opuscules ne portaient ni date ni adresse d'impression, et ils présentaient la particularité extraordinaire de paraître issus de la même imprimerie et de ne constituer qu'un seul et même volume, quand en réalité leur élaboration et leur réunion sous forme de recueil était le fruit d'une collaboration complexe entre plusieurs imprimeurs et libraires. Le typographe Cornelius von Zierickzee est le seul dont le nom apparaisse fugacement dans l'une des variantes du recueil, mais parmi les imprimeurs ayant vraisemblablement participé au projet figurent Heinrich Quentell et ses héritiers, Martin von Werden, Johann von Landen et Hermann von Bongart. L'exemplaire que nous présentons ici constitue la version la plus aboutie du "Kölner Sammelwerke", avec un total de 7 opuscules rassemblés sous le même titre, dans l'ordre suivant: "Modus Legendi", un célèbre lexique d'abbréviations juridiques destiné aux étudiants et paru pour la première fois à la fin du 15e siècle. "Rubrice sive Tituli Juris Canonici et Civilis secundum ordinem librorum redacti", liste des chapitres du Code Justinien publié séparément sous cette même forme dès 1502 et qui fut rajouté au recueil sans être annoncé au titre. On trouve ensuite l'édition collective des 3 textes suivants, qui sont tous cités sur le titre collectif: "Tractatus Judiciorum Bartholi legum doctoris expertissimi" paru à Toulouse dès 1486. "Tractatus renuntiationsi beneficiorum in publicis instrumentis". "Processus sathane infernalis contra genus humanum", ouvrage imaginant un procès mettant en scène Satan et la Vierge Marie, et orné de 3 gravures sur bois très curieuses. "Ars notariatus", un guide pour les notaires paru en Hollande dès la fin du 15e siècle. Et enfin deux ouvrages du juriste Johannes Andreas: "Summa Joan. An. Super secundo decretalium" et "Super quarto decretalium", illustré d'une gravure sur bois à pleine page. Les opuscules séparés sont tous très rares mais les différentes variantes du recueil sont, elles, pratiquement introuvables. Stintzing faisait notamment remarquer que cette collection avait échappé à tous les bibliographes, excepté Panzer et on ne répertorie actuellement, dans les collections publiques, qu'une poignée d'exemplaires comme le nôtre qui présentent le recueil dans sa version la plus complète. 2). Rarissime édition parisienne de ce texte de Trithème sur les moines propriétaires. Imprimée sans nom d'imprimeur, elle faisait partie de l'édition de Trithème donnée par Marnef ("De proprietate monachorum", c.1500) mais elle fut également diffusée séparément. Nous ignorons si son inclusion aux côtés du "Kölner Sammelwerke" fut faite à l'époque par les éditeurs colognais, ou si elle date de l'époque de la reliure. Bel exemplaire relié en maroquin au 18e siècle, et provenant de la bibliothèque du Marquis de Westerlo selon une note manuscrite ancienne sur un feuillet de garde. Précieux ensemble. 1).     Der im italienischen Sassoferrato geborene Verfasser (um 1313-1357) war einer der bedeutendsten Rechtslehrer des Mittelalters. Er gehörte zur Richtung der Kommentatoren.
